Wesley Chapel Car Accident Lawyer
Armando Personal Injury Law represents people injured in car crashes in Wesley Chapel. We investigate fault, review the insurance available, and pursue compensation supported by your injuries and losses. That can include a claim involving a rear-end collision on SR 54, a turning driver on SR 56, or a crash on I-75.
You may already have a claim number and still have no clear answer about who will pay for treatment or missed work. Call (813) 482-0355 or request a free consultation. We serve Wesley Chapel from our Tampa and St. Petersburg offices.

Most passenger vehicles record speed, braking, and seat belt data in the seconds before an airbag deploys, which can help show how a crash happened.
Start with your health and the evidence you have
Get medical attention for an injury and describe your symptoms accurately. A concussion may not be obvious immediately; MedlinePlus explains that symptoms can take hours or days to appear. Tell your healthcare provider about new or worsening symptoms rather than trying to decide yourself whether they are related to the crash.
If you can safely take photos, capture the vehicles, damage, lane markings, and surrounding area. Save witness contact information, the report number, insurance messages, and any dashcam recording. Keep the original files. You do not need to have every record before speaking with us.
The exact location helps. For a collision near an SR 56 shopping-center entrance, we may need to establish which driveway and lane each driver used. For an I-75 crash near an interchange, the sequence of braking and lane changes may matter more than where the vehicles finally stopped. These are questions to investigate, not assumptions about who caused the crash.
Which insurance may pay after a crash?
Different coverages address different losses. Having insurance does not necessarily mean a driver has bodily injury liability coverage sufficient for a serious injury. We review the policies and applicable limits instead of relying only on an insurance card.
Personal injury protection and the 14-day rule
Florida personal injury protection law generally pays 80% of covered, medically necessary expenses and 60% of covered lost income, regardless of fault. The standard $10,000 limit is shared by medical and disability benefits; it is not $10,000 for each.
Initial qualifying services and care must occur within 14 days of the crash for PIP medical benefits. Access to medical benefits above $2,500 requires an emergency medical condition determination by a physician, dentist, physician assistant, or advanced practice registered nurse authorized under the statute. An emergency medical condition determination does not guarantee a $10,000 payment. Covered charges, benefit percentages, deductibles, and available limits still matter.
The 14-day rule concerns PIP medical benefits. It is not the deadline to file an injury lawsuit. If that period has already passed, get advice about the remaining claims rather than assuming every option is lost.
Bodily injury liability and uninsured motorist coverage
An at-fault driver's bodily injury liability policy may pay covered injury losses, subject to proof of liability and the policy terms. PIP does not pay pain and suffering, and the requirements for recovering those damages are different.
Uninsured or underinsured motorist coverage, when available, can cover qualifying injury losses caused by a driver with no applicable liability insurance or insufficient coverage. We check who is insured, the limits, exclusions, and any signed rejection or selection of lower limits. It is not an automatic benefit under every auto policy.
Uber and Lyft coverage depends on the trip stage
Under Florida's rideshare insurance law, a driver logged in and available, but not engaged in a prearranged ride, must have at least $50,000 in bodily injury liability coverage per person, $100,000 per incident, and $25,000 in property damage liability coverage.
Once a driver accepts a ride request, the prearranged-ride period begins. During that period, the required primary liability coverage is at least $1 million for death, bodily injury, and property damage. It is not a guaranteed payment to each injured person. The law permits the required coverage to come from the driver or vehicle owner, the rideshare company, or a combination.
Save your trip receipt and app information. An empty passenger seat does not necessarily mean the lower limits apply: the driver may already have accepted a pickup. Food delivery work involves different policy questions and should not be treated as passenger rideshare coverage.
How we investigate fault
A rear-end crash, a left-turn collision, and a multivehicle collision call for different evidence. In our car accident practice, we look at the drivers' actions, the sequence of impacts, and the records that may resolve conflicting accounts.
Potential evidence includes witness statements, available business or dashcam video, vehicle damage, and electronic vehicle data. What a vehicle records varies by model and event. Video may not exist or may be overwritten, so identifying possible sources early can matter.
If you suspect the other driver was using a phone
Describe what you actually saw. Looking down could support further investigation, but it does not by itself prove texting or establish why a collision happened.
Section 316.305 permits wireless billing records to be admitted as evidence in a crash resulting in death or personal injury to determine whether a texting violation occurred. Records still need to be obtained lawfully and matched to the relevant time; their existence does not automatically prove fault.
Section 316.306 restricts handheld device use while driving in designated school crossings and school zones. For work zones, construction personnel must be present or operating equipment on the road or immediately adjacent to the zone. The rule has exceptions, including specified emergency uses, and does not apply to a stationary vehicle.
Getting and checking your Pasco crash report
Start with the investigating agency shown on your paperwork. The Pasco Sheriff's Office says Florida Highway Patrol handles most traffic-crash investigations in Pasco County. If deputies responded, ask whether the sheriff's office generated a report.
For a crash involving injury or a complaint of pain, Florida law requires the investigating officer to complete and submit a long-form report within 10 days after finishing the investigation. That is not necessarily 10 days after the crash.
Check the names, vehicles, insurance information, witnesses, and diagram. Our guide to Florida crash reports explains the report's main sections. Point out errors and keep any independent evidence that helps explain them.
A report can help an investigation without deciding a civil case. Section 316.066 protects specified reports and statements made by people involved in a crash for reporting purposes. That protection does not make every independent observation or piece of physical evidence unusable. Trial admissibility needs separate review.
What compensation may include
Depending on the evidence, insurance, and applicable law, a claim may include medical expenses, lost income, reduced earning capacity, and pain and suffering. Future care needs must have support. The amount printed on a medical bill is not necessarily the recoverable amount under Florida's medical-expense rules.
In motor-vehicle cases where section 627.737 applies, pain-and-suffering damages require a qualifying injury:
- Significant and permanent loss of an important bodily function.
- Permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement.
- Significant and permanent scarring or disfigurement.
- Death.
Exhausting PIP benefits alone does not satisfy that threshold. We review the medical evidence and how the injury affects your daily life before discussing what damages may be available.
Deadlines and shared fault
Most ordinary Florida negligence claims accruing after March 24, 2023, have a two-year lawsuit deadline under section 95.11 and the 2023 legislation. Earlier claims require separate review. The claim type and circumstances can change the applicable deadline or notice requirements. Insurance negotiations do not substitute for filing a lawsuit on time.
Under section 768.81, an injured person more than 50% responsible for their own harm cannot recover in negligence actions governed by that rule. At exactly 50%, recovery is reduced rather than barred. An adjuster's accusation is not a final determination of fault.
Questions about your car accident claim
Is the driver who rear-ended me always responsible?
Not automatically. Florida courts recognize a presumption of negligence against the rear driver, but evidence that another driver contributed to the collision can rebut it. The Florida Supreme Court explained that distinction in Cevallos v. Rideout.
Florida law also requires drivers to maintain a reasonable and prudent following distance, considering speed, traffic, and road conditions. A rear impact is important evidence, but we also examine lane changes, braking, and any earlier collision that pushed a vehicle forward. The full sequence matters.
What if I was a passenger?
Depending on fault, an injured passenger may have a claim against the driver of the vehicle they occupied, another driver, or both. PIP eligibility and priority require review of the passenger's own coverage, household coverage, vehicle ownership, and the occupied vehicle's policy. Do not assume the driver's policy is always the first or only source.
Can I claim lost income if I am self-employed?
You may be able to recover income lost because of the injury. Tax returns, invoices, canceled jobs, and business records can help distinguish your usual earnings from the income actually lost. Gross business revenue is not automatically the same as your personal lost income. We also examine whether the injury affects your ability to earn in the future.
Should I accept an insurance offer while treatment continues?
Have the offer and release reviewed before signing. A release may end your right to seek more payment for the same injury, even if later treatment costs more than expected. Bring the offer, medical information, and any payment deadlines to the consultation so we can discuss what is known and what remains uncertain.
Should I give a recorded statement or sign a medical authorization?
First identify who is asking and what they need. A request from the other driver's liability insurer is different from a request under your own policy, which may impose cooperation duties. Ask for the scope of any medical authorization and get advice before signing. Relevant earlier medical records may be needed; they are not automatically off-limits simply because they predate the crash.
Working with Armando Personal Injury Law
The firm's published results include a $500,000 policy-limit settlement after a left-turn collision involving back and neck injuries, and a $10,000 policy-limit settlement in a rear-end whiplash case where the initial offer was $500. These are prior outcomes reported by the firm, not estimates or promises for your case.
At a free consultation, we can discuss the crash, the insurance responses, and the information needed to evaluate your claim. If we take the case, the contingency fee agreement explains the attorney's fee and how expenses are handled. Ask about a home or workplace visit if travel is difficult.
