Lauderdale, Plantation, or Hollywood Florida and need assistance with a loss suffered due to a major storm, call us today, and let us help you start getting your life back together.

Tropical Storm Irma was a beast.  She slammed into the Florida coast as a Category 4 Hurricane.  With winds speeds up to 130 mph, and moving at roughly 8 mph, Irma left little but destruction in her wake.

In the Florida Keys, storm surges are thought to have reached as high as 4 feet, while the northern coast town of Fernandina Beach saw storm surges as high as 7.5 feet.  With such extremely high winds, and storm surge levels that haven’t been seen in decades, it is no wonder that much of Florida’s east coast has been left in complete devastation.

“This is a deadly storm and our state has never seen anything like it”

Florida Governor Rick Scott (R) on Hurricane Irma

Hurricane Irma decimated much of the property held by Floridians.  In the Florida Keys alone, it is estimated that 90% of the properties have sustained some sort of damage, while 25% of the homes have been completely destroyed.  With the told damage caused by Irma, in Florida alone, coming in at roughly $100 billion, it will be hard for insurance companies to keep up.

Nursing Home Residents Die from Heat Exhaustion, Dehydration

On top of all of the physical damage, Hurricane Irma left emotional devastation in her wake as well.  Families are mourning the loss of 8 elderly residents at a Hollywood nursing home.  While there is no legal cause of death yet, the Rehabilitation Center at Hollywood Hills had lost power to most of the facility and temperatures were dangerously high.  With multiple 911 calls coming in to transport residents in distress to the nearby hospital, fire crews were sent in to investigate, determined the conditions to be unsafe, and evacuated the remaining residents.  Considering the fact that this Hollywood nursing home has been cited in the past for safety violations (2 of which were for not properly maintaining a back-up generator), many families believe that these deaths are a direct result of nursing home negligence and elderly abuse.

In an effort to curb the loss of life due to the power outages, another 42 nursing homes and assisted living facilities were checked out by police and fire crews, which resulted in an additional 79 elderly and infirm being evacuated from the Krystal Bay Nursing and Rehabilitation Center, due to the dangerously high heat in the facility.

Florida Governor Rick Scott has pledged to aggressively investigate the conditions that lead to these nursing home deaths, but that is of little consolation to the families and loved ones of the deceased.  To already have so much loss and devastation throughout Florida because of Irma, and then the crushing emotional and financial blow of losing a loved one, can almost see like too much to bare.

If you have suffered the loss of a loved one due to gross neglect of those entrusted to care for them, the lawyers at Armando Personal Injury Law Firm can help.  We have lawyers experienced in nursing home abuse and neglect, as well recouping from private and state funded insurance companies after major loss of damage to property.  We are dedicated to the people of Florida and committed to seeing justice done.  Our bilingual attorneys will provide an initial consultation at no cost, and we never seek payment from a client unless we win their case.  We can offer services in the following areas:

  • My relative died at a nursing home after Hurricane Irma. Do I have grounds for a wrongful death lawsuit and if so, is the nursing home at fault?

While some may blame the nursing home deaths squarely on Hurricane Irma, it is indeed up to the facility in question to either evacuate when danger is imminent or to provide a satisfactory level of care while riding out the storm. If neither occurs, nursing home negligence may be the cause of death.  A satisfactory level of care would include, but not be limited to, ensuring that standby generators are in place and in proper working order, having enough food and water on hand to last several days, keeping enough staff on hand to adequately care for all residents, and having an emergency back-up plan should any of these precautions fail.  To learn more about the Hollywood Florida nursing home deaths, and could have been done to prevent them, read our post about it:

  • What are my options if I feel like my loved one was neglected in a nursing home or other care facility and sustained injuries during or after a hurricane?

If you feel that there was any form of neglect or abuse to your elderly loved one during a natural disaster, you should seek the counsel of an accomplished attorney immediately.  The lawyers at Armando Personal Injury Law Firm in Fort Lauderdale, Florida have extensive experience handling neglect, abuse, and wrongful death suites against those that have been entrusted with elderly loved ones.  We will listen to your story, gather evidence, and build a strong case to ensure the compensation of our clients.

  • How much does it cost to hire a nursing home neglect lawyer?

The attorneys at Armando Personal Injury Law Firm will provide you with an initial consultation at absolutely NO COST!  If we are unable to win your case for you, you owe us nothing.  If we do successfully win your lawsuit for the nursing home’s negligence towards a loved one, our fee is established as a percentage of the proceeds won.

  • How much does it cost to hire an insurance claim lawyer?

Florida has a very clear law about how a property damage lawyer is compensated.  Florida Statute 627.428 outlines that attorneys’ fees are to be paid by the insurance company as part of the settlement.  In some cases we are paid a percentage of the revenue awarded, but either way, we are only paid if we win your case your you!

  • How long do I have to file a claim associated with a major storm?

Pursuant to a claim of neglect of an elderly loved one, the Florida Statute 429.296 states that:

“Any action for damages brought under this part shall be commenced within 2 years from the time the incident giving rise to the action occurred or within 2 years from the time the incident is discovered, or should have been discovered with the exercise of due diligence; however, in no event shall the action be commenced later than 4 years from the date of the incident or occurrence out of which the cause of action accrued.”

While there are some exceptions to this, it is important to seek the counsel of an attorney as soon as possible.  With the help of an experienced Florida neglect lawyer, evidence can begin to be gathered and documented immediately, witnesses can be interviewed while facts are still clear in their memory, and all parties involved can be tracked down to participate in the proceedings.

Pursuant to a property damage claim, Florida Statute 627.70132 states that:

“A claim, supplemental claim, or reopened claim under an insurance policy that provides property insurance, as defined in s.624.604, for loss or damage caused by the peril of windstorm or hurricane is barred unless notice of the claim, supplemental claim, or reopened claim was given to the insurer in accordance with the terms of the policy within 3 years after the hurricane first made landfall or the windstorm caused the covered damage.”
